Terms and Conditions for Strat-O

These Terms and Conditions ("Terms") govern access to and use of the Strat-O web application (the "Service"), operated by Laurin Maurer ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use the Service. These Terms apply to all visitors, registered users, participants, athletes, supporters, paying users, and any other person using the Service.

2. Description of the Service

Strat-O is a fantasy orienteering game. The Service allows users to create fantasy teams, relay teams, predictions, bonus answers, and other game-related entries based on real-world orienteering athletes and events.

Some parts of the Service may be free. Other parts may require paid access, including a Daily Licence, Monthly Pass, Season Pass, supporter status, or another paid digital access product.

The Service is provided for entertainment, community, and informational purposes only. It is not gambling, betting, financial investment, employment evaluation, official athlete ranking, or an official competition operated by any federation or event organizer.

No real money, cash prize, financial instrument, item of monetary value, or legally enforceable reward can be won through gameplay unless we expressly publish separate written rules for a specific promotional campaign.

3. Eligibility and Minors

You may use the Service only if you are legally able to enter into these Terms under the laws applicable to you.

If you are a minor, you may use the Service only with the consent and supervision of a parent or legal guardian where such consent is required. By using the Service, you confirm that you meet these requirements.

We may restrict, suspend, or delete accounts where we reasonably believe that the user is not eligible to use the Service or that required parental or guardian consent has not been obtained.

4. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access, misuse, or a security breach.

We may refuse registration, suspend access, require verification, or terminate accounts where we reasonably believe that account information is false, misleading, outdated, abusive, or used in violation of these Terms.

5. One Account Per Person

Each natural person may maintain only one account. Creating, controlling, sharing, or using multiple accounts to manipulate scores, bypass restrictions, influence leaderboards, avoid sanctions, or gain any unfair advantage is strictly prohibited.

We may use technical, behavioral, and account-related signals to detect duplicate or abusive accounts, including email addresses, login patterns, device information, IP addresses, browser information, gameplay patterns, timing, and other security indicators.

If we reasonably determine that multiple accounts are controlled by the same person or used abusively, we may merge, suspend, reset, disqualify, or permanently ban any associated accounts and remove related scores, rankings, entries, or rewards.

6. Game Rules, Scoring, and Final Decisions

Scores, rankings, star ratings, discounts, bonuses, penalties, event classifications, relay assignments, and leaderboard results are calculated according to rules, formulas, data sources, and administrative decisions determined by us.

We may correct errors, recalculate scores, adjust rankings, void entries, change scoring formulas, update athlete data, modify budgets, correct event metadata, and resolve disputes where reasonably necessary to preserve fair play, correct technical mistakes, or protect the integrity of the Service.

Fantasy scores and rankings are part of a game. They do not represent an official sporting result, definitive athlete evaluation, market valuation, or statement about a person’s worth, talent, health, reliability, or character.

Unless required by law, our decisions regarding game operation, scoring, rankings, eligibility, sanctions, and rule interpretation are final.

7. Fair Play

You agree to play fairly and not undermine the integrity of the Service. Prohibited conduct includes:

  • creating or using multiple accounts;
  • impersonating another person or athlete;
  • linking your account to an athlete profile that does not belong to you;
  • manipulating, scraping, attacking, or interfering with the Service;
  • exploiting bugs, race conditions, scoring errors, payment errors, or permission mistakes;
  • using automation, bots, scripts, or unauthorized tools;
  • attempting to access non-public data, admin tools, databases, APIs, or accounts;
  • intentionally submitting false, misleading, or abusive information;
  • colluding to manipulate leaderboards, bonus questions, public guesses, or scores;
  • attempting to influence real-world athletes, teams, organizers, or results for fantasy-game purposes.

If you discover a vulnerability, bug, scoring issue, payment issue, data leak, or loophole, you must not exploit it. Please report it to strategyorienteering@gmail.com.

8. Athlete Profile Linking

If the Service allows linking a user account to an athlete profile, you may only link to a profile that genuinely belongs to you. Impersonation, false linking, or misleading identity claims are prohibited.

We may request reasonable verification before approving, maintaining, or restoring a linked athlete profile. We may remove a link if we reasonably believe it is false, disputed, abusive, outdated, or harmful to the integrity of the Service.

By linking your account to an athlete profile, you acknowledge that your athlete name, profile image, country, club, public results, scores, rankings, and game-related activity may be displayed publicly or semi-publicly within the Service.

9. Self-Selection, Discounts, and Bonus Questions

The Service may include special game mechanics for linked athlete profiles, such as self-selection discounts, star discounts, eligibility restrictions, or bonus question limitations.

You must not disconnect, reconnect, manipulate, or misrepresent your athlete profile to bypass rules, answer self-related questions, gain discounts improperly, avoid restrictions, or obtain an unfair advantage.

We may remove entries, reset answers, revoke discounts, recalculate scores, or suspend accounts where we reasonably believe these mechanics have been abused.

10. User Content

You are responsible for all information and content you submit, including display names, profile information, team selections, bonus answers, feedback, support messages, and any other input.

You must not submit content that is unlawful, defamatory, abusive, hateful, discriminatory, harassing, threatening, sexually explicit, misleading, spam, infringing, privacy-invasive, or otherwise harmful.

By submitting content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, publish, and use that content solely as reasonably necessary to operate, improve, promote, protect, and document the Service.

You retain ownership of your own content, subject to the rights granted in these Terms and the public or semi-public nature of gameplay features.

11. Public Display of Game Data

The Service includes public and semi-public features. Your display name, linked athlete identity, profile image, teams, relay assignments, scores, rankings, club-related visibility, public guesses, and other gameplay information may be visible to other users or the public.

You acknowledge that participation in the Service may involve public comparison, rankings, predictions, leaderboards, and fantasy-game discussion. You must not use the Service to harass, pressure, shame, target, or abuse real-world athletes or users.

12. Public Athlete Data and Third-Party Sources

The Service relies on third-party and public sources for athlete data, event information, start lists, results, rankings, clubs, countries, profile images, and related sports data. Sources may include IOF/Eventor, event organizers, federations, timing providers, public websites, or official APIs.

We do not guarantee that third-party data is accurate, complete, current, available, or error-free. We may correct, remove, update, override, or estimate data where reasonably necessary for gameplay.

If you are an athlete and believe data about you is inaccurate, outdated, or inappropriate, contact us.

13. No Affiliation

Strat-O is independent. Unless expressly stated otherwise, the Service is not affiliated with, sponsored by, endorsed by, or officially connected with the International Orienteering Federation, IOF, Eventor, national federations, local clubs, event organizers, timing providers, sponsors, athletes, or teams.

Names, logos, trademarks, event names, federation names, athlete names, and other third-party identifiers belong to their respective owners and are used for identification, commentary, or gameplay context only.

14. Acceptable Use

You must not:

  • violate any applicable law or regulation;
  • infringe intellectual property, privacy, publicity, or personality rights;
  • upload malware or attempt to compromise security;
  • probe, scan, or test vulnerabilities without authorization;
  • reverse engineer, copy, resell, sublicense, or commercially exploit the Service;
  • interfere with servers, networks, APIs, databases, Firebase resources, or payment systems;
  • use the Service for spam, scraping, credential harvesting, or unauthorized data collection;
  • circumvent access controls, rate limits, authentication, paywalls, licences, or security rules;
  • share, resell, transfer, or sublicense paid access, passes, licences, or premium features;
  • misuse sponsor links, supporter features, payment systems, or communication systems;
  • damage the reputation, safety, or enjoyment of the orienteering community.

15. Enforcement

We may investigate suspected violations. We may suspend, restrict, reset, shadow-limit, disqualify, delete, or permanently ban accounts or entries if we reasonably believe that these Terms, game rules, fair-play principles, or payment rules have been violated.

We may also remove content, reverse points, recalculate rankings, revoke paid access, block devices or IP addresses, deny future registrations, or take other reasonable measures to protect the Service and its users.

We are not required to provide advance notice where immediate action is needed to protect security, prevent abuse, preserve evidence, comply with law, prevent payment fraud, or protect users.

16. Supporter Status, Donations, Paid Access, Licences, and Passes

The Service may offer voluntary contributions, donations, supporter features, paid digital products, paid access, subscriptions, licences, passes, or similar features.

These may include, but are not limited to:

  • Daily Licence: temporary access to selected paid features for a limited daily access period;
  • Monthly Pass: temporary access to selected paid features for a monthly access period;
  • Season Pass: temporary access to selected paid features for a defined season or event period;
  • Supporter Status: voluntary support of the Service, which may be acknowledged with a badge or similar non-competitive recognition;
  • Premium Features: additional digital functionality such as advanced statistics, historical data, Scout Intelligence, premium recaps, enhanced event coverage, analytics, or other features made available from time to time.

Any payment made to Strat-O primarily helps reduce and cover the costs of hosting, operating, maintaining, securing, developing, and improving the platform. These costs may include servers, databases, data storage, third-party tools, payment processing, email delivery, software development, administration, security, backups, and other operational expenses.

Payments are intended to support the operation of the Service and reduce the financial burden of running the platform. They do not constitute an investment, ownership interest, shareholder right, partnership, donation to a registered charity, revenue-sharing arrangement, or entitlement to influence the operation of the Service.

Supporter status, Daily Licences, Monthly Passes, Season Passes, subscriptions, and paid features do not grant any competitive advantage unless a specific paid feature is expressly described as gameplay-related. They do not grant influence over athlete ratings, scoring rules, event selection, moderation decisions, data corrections, or game results.

17. Paid Digital Access Terms

Subject to successful payment and compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access the purchased digital features during the applicable access period.

Paid access is for your personal use only. You may not sell, transfer, rent, lend, share, sublicense, commercially exploit, or make paid features available to another person.

Paid access may start immediately after purchase or once the relevant feature, event, day, month, or season becomes available, depending on the specific product description shown at checkout or in the Service.

A Daily Licence, Monthly Pass, Season Pass, or other paid product grants access only to the features described for that product at the time of purchase. It does not guarantee access to every current or future paid feature.

We may use third-party payment providers to process payments. Payment providers may apply their own terms, privacy policies, fees, checks, fraud prevention measures, and transaction rules.

18. Prices, Taxes, Billing, and Renewals

Prices, currencies, taxes, billing periods, access periods, and included features will be shown in the Service, at checkout, or in the product description before purchase where required by applicable law.

Prices may change at any time for future purchases. Price changes do not affect an already purchased access period unless expressly stated and permitted by law.

If a Monthly Pass, Season Pass, or other paid product is offered as a recurring subscription, the renewal terms, billing frequency, cancellation method, and renewal price will be disclosed before purchase.

You are responsible for cancelling recurring subscriptions before the next billing cycle if you do not want the subscription to renew.

We may suspend or revoke paid access if payment fails, is reversed, is refunded, is subject to a chargeback, appears fraudulent, or violates payment provider rules.

19. Refunds, Cancellations, and Consumer Withdrawal Rights

Except where required by applicable law or expressly stated otherwise, payments for Daily Licences, Monthly Passes, Season Passes, supporter status, subscriptions, digital content, and other paid digital services are non-refundable once access has started or the digital service has been made available.

If you are a consumer in Switzerland, the EU, EEA, UK, or another jurisdiction with mandatory consumer protection rules, you may have cancellation, withdrawal, refund, or other rights that cannot legally be excluded. Nothing in these Terms limits those mandatory rights.

Where legally permitted, by purchasing and using immediate digital access, you may be asked to consent to immediate performance and acknowledge that you may lose any statutory withdrawal right once the digital service has begun or the digital content has been made available.

If a paid feature is materially unavailable for a significant part of an active paid access period due to reasons within our reasonable control, we may, at our discretion and where legally permitted, provide an extension, replacement access, partial credit, or other reasonable remedy.

No refund or compensation is owed for minor bugs, temporary interruptions, third-party outages, data-source errors, scheduled maintenance, user device issues, internet connection problems, force majeure events, or suspensions caused by your breach of these Terms, except where required by law.

20. Paid Features, Errors, and No Guaranteed Outcome

Paid access does not guarantee uninterrupted service, error-free operation, availability at all times, permanent availability of a specific feature, preservation of all data, compatibility with all devices, or uninterrupted access to third-party integrations or data sources.

The Service may contain bugs, calculation errors, display errors, data delays, missing athlete information, incorrect event data, third-party API failures, payment provider issues, or other technical problems. We will try to correct significant problems where reasonably possible, but errors may still occur.

Purchase of a Daily Licence, Monthly Pass, Season Pass, supporter status, subscription, or premium feature does not guarantee competitive success, better rankings, improved fantasy performance, access to specific athletes, access to specific events, future feature availability, future updates, or any particular outcome.

Paid features may be modified, improved, replaced, suspended, discontinued, or removed where reasonably necessary for operational, technical, legal, security, cost, or product reasons.

21. Sponsorships, Advertisements, and Third-Party Links

The Service may display sponsors, advertisements, partner links, affiliate links, or other third-party content. Sponsored content does not mean that we endorse or guarantee the third party, its products, services, claims, privacy practices, or website security.

If you click a third-party link, you leave the Service and interact with that third party at your own risk. Third-party terms and privacy policies apply.

We do not share private account data or private team data with sponsors unless we clearly disclose this and, where required, obtain your consent.

22. Intellectual Property

The Service, including its design, software, code, graphics, interface, branding, scoring systems, fantasy mechanics, text, original content, and non-user-created materials, is owned by us or our licensors and is protected by intellectual property laws.

You may use the Service only for personal, non-commercial purposes unless we give prior written permission. You may not copy, modify, distribute, sell, lease, host, mirror, scrape, or create derivative works from the Service except as permitted by law or these Terms.

23. Feedback

If you provide suggestions, ideas, bug reports, feature requests, or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, implement, publish, and exploit that feedback without compensation or obligation to you.

24. Availability and Changes to the Service

We may modify, suspend, limit, replace, or discontinue any part of the Service at any time. This includes free features, paid features, scoring, data sources, athlete ratings, event availability, leaderboards, public guesses, live trackers, recaps, supporter features, account functionality, Daily Licences, Monthly Passes, Season Passes, and premium digital services.

We do not guarantee uninterrupted availability, error-free operation, continued support, preservation of historic data, or compatibility with all devices, browsers, or regions.

We may perform maintenance, updates, migrations, security fixes, or emergency interventions that temporarily limit or interrupt access to free or paid parts of the Service.

25. Privacy and Data Protection

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge that your personal data will be processed as described there.

The Privacy Policy forms part of the overall relationship between you and us, but any rights you have under applicable data protection laws remain unaffected.

26. Consumer Rights

Nothing in these Terms excludes, restricts, or limits rights that cannot be excluded under applicable consumer protection law.

If you are a consumer in Switzerland, the EU, EEA, UK, or another jurisdiction with mandatory consumer protections, you may have mandatory legal rights that override conflicting parts of these Terms.

For paid digital services, applicable consumer laws may require specific pre-contract information, price information, cancellation information, withdrawal rights, withdrawal exceptions, renewal notices, invoice information, tax information, or complaint procedures. Where such rules apply, they remain unaffected by these Terms.

27. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise.

We do not warrant that the Service will be uninterrupted, secure, accurate, complete, timely, error-free, virus-free, compatible with your device, or suitable for any particular purpose.

We do not warrant the accuracy, completeness, legality, reliability, or availability of third-party data, athlete data, event results, APIs, public sources, sponsor content, payment providers, or external websites.

This disclaimer applies equally to free and paid portions of the Service, including Daily Licences, Monthly Passes, Season Passes, supporter status, subscriptions, premium analytics, Scout Intelligence, recaps, live trackers, and other paid digital services.

28. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, punitive, or similar damages, including loss of data, loss of profits, loss of goodwill, loss of enjoyment, loss of opportunity, reputational harm, service interruption, payment interruption, third-party provider failure, or unauthorized access.

To the fullest extent permitted by applicable law, our total liability arising out of or relating to the Service or these Terms is limited to the greater of: (a) the amount you paid us for the Service in the twelve months before the claim arose; or (b) CHF 50.

The purchase of a Daily Licence, Monthly Pass, Season Pass, supporter status, subscription, or premium feature does not create a higher duty of care, guarantee of availability, guarantee of uninterrupted service, or guarantee of error-free operation beyond what is expressly required by applicable law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is not permitted by law, including liability for unlawful intent, gross negligence where such limitation is not enforceable, death or personal injury caused by unlawful conduct, or mandatory consumer rights.

29. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your content, your violation of these Terms, your violation of law, your infringement of third-party rights, payment disputes caused by your conduct, chargebacks caused by misuse, or misuse of your account.

This indemnity does not apply where prohibited by mandatory consumer protection law.

30. Suspension and Termination

You may stop using the Service at any time. You may request account deletion by contacting us, subject to our Privacy Policy, legal obligations, legitimate retention needs, and preservation of game integrity.

We may suspend or terminate your access at any time if we reasonably believe that you violated these Terms, created risk or legal exposure, abused the Service, compromised fair play, failed to pay, initiated abusive chargebacks, or harmed other users, athletes, payment systems, or the Service.

Suspension or termination may include loss of access to free and paid features. Where suspension or termination results from your breach of these Terms, no refund is owed except where required by law.

After termination, provisions that by their nature should survive will survive, including intellectual property, public game history, payment obligations, disclaimers, limitation of liability, indemnity, governing law, and dispute provisions.

31. Account Deletion and Game History

If your account is deleted, some game-related data may remain visible, anonymized, aggregated, or retained where reasonably necessary to preserve event history, leaderboards, scoring integrity, legal records, payment records, security logs, or legitimate operational interests.

We may replace your display name with an anonymized identifier where appropriate, unless continued display is legally permitted and necessary for game integrity or public competition history.

32. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the "Last Updated" date. If changes are material, we may notify users through the Service or by email where appropriate.

Your continued use of the Service after updated Terms become effective means that you accept the updated Terms. If you do not agree, you must stop using the Service.

If changes materially affect an active paid access period, we will handle the change in accordance with applicable law and any specific product terms shown at purchase.

33. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions remain in full force. The invalid provision will be interpreted or replaced to the extent necessary to achieve its intended economic and legal purpose as closely as possible.

34. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights. Any waiver must be in writing to be effective.

35. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a reorganization, transfer of the Service, merger, acquisition, or similar event, provided that your mandatory rights remain unaffected.

36. Governing Law and Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

Subject to mandatory consumer protection rules and mandatory places of jurisdiction, the courts of Zurich, Switzerland, have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.

If you are a consumer, you may also have the right to bring claims in the courts of your place of residence where mandatory law grants you that right.
